ORDINANCE NO. 821
AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF COLUSA REPEALING ORDINANCE NO. 701 ESTABLISHING THE ARBUCKLE-COLLEGE CITY
TRAFFIC FEE AND REPEALING ORDINANCE NO. 705 ESTABLISHING
COUNTYWIDE DEVELOPMENT IMPACT FEES
The Board of Supervisors of the County of Colusa ordains as follows:
Section 1. This Ordinance does hereby repeal Ordinance No. 701, adopted by the Colusa County Board of Supervisors on May 30, 2006, establishing the Arbuckle-College City Traffic Development Impact fee as of the date of Section 3 of this Ordinance.
Section 2. This Ordinance does hereby repeal Ordinance No. 705, adopted by the Colusa County Board of Supervisors on November 28, 2006, establishing County-Wide Development Impact fees as of the date of Section 3 of this Ordinance.
Section 3. The operative date of the repeal of Ordinances 701 and 705 shall be the date that the 2021 Colusa County Development Impact Fee Update and Nexus Study adopted by a Board of Supervisor’s Resolution pursuant to Section 38-3 of the County Code becomes effective.
Section 4. The Board of Supervisors finds, pursuant to Title 14 of the California Code of Regulations, Section 1506l (b)(3), that this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect on the environment.
Section 5. This ordinance shall take effect thirty (30) days from its passage. It shall be published once with the names of the members of the Board of Supervisors voting for and against the ordinance in a newspaper of general circulation published in the Count of Colusa, State of California, within fifteen (15) days after its passage.
Introduced at a regular meeting of the Board of Supervisors held on the 14th day of December 2021, and passed and adopted by the Board of Supervisors of the County of Colusa, State of California, at a regular meeting of the Board of Supervisors on the 4th day of January, 2022 by the following vote:
AYES: Supervisors Daurice K. Smith, Denise J. Carter, Kent S. Boes, J. Merced Corona and Gary J. Evans.
NOES: None.
