Monday was as good as any for a San Fernando Valley man to go to jail.
Colusa County Superior Court Judge Jeffrey A. Thompson ordered David Franklin, Husted, 58, who had his sentence delayed more than two years because of cancer treatment, to finally face his punishment for the road rage incident in late 2018 that resulted in his conviction.
Husted, who has been out on bail since his arrest, appeared in Colusa County Superior Court on May 2 and was ordered to report to the Colusa County Jail by 4 PM, despite pleadings from his attorney to allow him to serve his time on house arrest.
Husted was initially accused of assault with a deadly weapon, assault by means likely to produce great bodily injury, reckless driving, and brandishing a replica gun after he reportedly tried to intimidate and run motorist, Paul Davis, off the road because “he got in his way,” according to District Attorney Attorney Matthew Beauchamp, at an earlier hearing.
Husted pleaded no contest on Oct. 9, 2019, to a single felony assault charge, in a plea deal that dismissed charges that could have sent him to prison for up to six years.
Although Husted has never failed to appear before the court as ordered, and has apologized profusely for the incident on Interstate-5, Thompson said Husted must serve his time, now that medical records presented to the court show improvement in his condition.
Husted, who was sentenced to 180 days in jail and 36 months formal probation, will likely serve about three months and could be eligible to transfer probation to his home county when he is released. ■
