Lawsuit over Colusa housing development moved to Sacramento County 

The lawsuit between the Colusa County Board of Supervisors and the Colusa City Council over the Sunrise Landing housing development at Colusa Industrial Properties will be heard in Sacramento County Superior Court. 

Colusa County Superior Court Judge Jeffrey A. Thompson, on Monday, ruled on a change of venue motion filed by the City of Colusa, after attorney’s representing Colusa County withdrew their opposition. 

The Colusa County Board of Supervisors, which also represents the Colusa County Airport Land Use Commission, are seeking an injunction to compel the City of Colusa to do additional environmental review on the housing project, which changed significantly in scope since it was first approved. 

Construction will continue on the project as it moves through the court process, as Colusa County lost its bid in court last month for a temporary restraining order. 

According to Colusa County, who filed the lawsuit on Jan. 25, the Colusa City Council approved the expanded project, in 2018, without formally notifying the Airport Land Use Commission of changes in the project’s scope, which they claim are incompatible with the airport, place the safety of the public at risk, and puts the airport’s future in jeopardy. 

Colusa County also claimed that the City Council, in approving the project, never mitigated the County’s concerns regarding the project’s impact on schools, traffic, and law enforcement. 

Colusa claims the housing project was properly vetted and approved, and that the project, increasing the number of homes from 84 homes to 180, included the elimination of the multi-family units proposed in the project’s initial scope, and a congregate community facility at the golf course, resulting in a net decrease in overall population.  

Thompson said Monday he would have the court clerk notify Sacramento County that the lawsuit would be coming to them, and that the court would also notify both sides when a court date has been determined.
