COUNTY OF COLUSA
ORDINANCE NO. 816

AN ORDINANCE OF THE COLUSA COUNTY BOARD OF SUPERVISORS ADOPTING A ZONING AMENDMENT (PD-21-26) TO AMEND SECTIONS 44-2.20.20, 44-2.40.20, AND 44-2.50.20 OF THE COUNTY CODE TO CLARIFY THAT THE TRAFFIC VOLUME LIMITS APPLY TO NEW TRAFFIC LEVELS AND FINDING THAT THE TEXT AMENDMENT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT

The Board of Supervisors of the County of Colusa ordains as follows:

SECTION 1.

The provisions of this ordinance are exempt from the California Environmental Quality Act pursuant to

14 CCR § 15301 Existing Facilities (Title 14, Division 6, Chapter 3, Article 19, Section 15301) in that the project involves the operation and permitting of existing public or private structures involving negligible or no expansion of existing or former use. 

SECTION 2.

Section 44-2.20.20 (b) (2) of the Colusa County Code is hereby amended to read as follows:

“Maximum Daily Trips. New Daily trips shall not exceed an additional one-hundred (100) car or light truck vehicle trips or an additional seventy (70) heavy truck or bus vehicle trips, or a combination of the two over existing or previously established traffic volumes.”

SECTION 3.

Section 44-2.40.20 (b) (2) of the Colusa County Code is hereby amended to read as follows:

“Maximum Daily Trips. New Daily trips shall not exceed an additional one hundred (100) car or light truck vehicle trips or an additional seventy (70) heavy truck or bus vehicle trips, or a combination of the two over existing or previously established traffic volumes.”

SECTION 4.

Section 44-2.50.20 (b) (2) of the Colusa County Code is hereby amended to read as follows:

“Maximum Daily Trips. New Daily trips shall not exceed an additional one hundred (100) car or light truck vehicle trips or an additional seventy (70) heavy truck or bus vehicle trips, or a combination of the two over existing or previously established traffic volumes.”

SECTION 5.

This ordinance shall become effective thirty (30) days after its passage. It shall be published once with the names of the members of the Board of Supervisors voting for and against the ordinance in a newspaper of general circulation published in the County of Colusa, State of California, within fifteen (15) days after its passage.

Introduced and passed and adopted by the Board of Supervisors of the County of Colusa, State of California, on the 26th day of October, 2021, by the following roll call vote:

AYES: Supervisors Daurice K. Smith,
Denise J. Carter, J. Merced Corona,
and Gary J. Evans. 

NOES: None. 

ABSENT: Supervisor Kent S. Boes.
