COUNTY OF COLUSA
ORDINANCE NO. 818

AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF COLUSA TO REPEAL CHAPTER 45 AND CREATE ARTICLE XIX OF CHAPTER 2 OF THE COLUSA COUNTY CODE

THE BOARD OF SUPERVISORS OF THE COUNTY OF COLUSA ORDAINS AS FOLLOWS:

SECTION 1. PURPOSE.

The purpose of this ordinance is to repeal Chapter 45 of the Colusa County Code to remove the Colusa County Personnel Practices from the Colusa County Code and replace it with a new Article under Chapter 2 that will authorize the Board of Supervisors to adopt Colusa County Personnel Rules and policies by resolution.

SECTION 2. FINDINGS.

The Board of Supervisors of the County of Colusa finds that the current system of maintaining the Colusa County Personnel Practices in the Colusa County Code is burdensome and inefficient.  The Board of Supervisors of the County of Colusa further finds that removing the Colusa County Personnel Practices from the Colusa County Code and allowing the Personnel Rules to be adopted by resolution will be beneficial to both the County of Colusa and its employees by allowing for the creation and modification of the Personnel Rules to more be done more quickly and efficiently and at less expense to the taxpayers of Colusa County.

SECTION 3. THE ORDINANCE

A. Chapter 45 of the Colusa County Code is hereby repealed in its entirety.

B. Article XIX is hereby added to Chapter 2 Administration of the Colusa County code to read:

Article XIX COLUSA COUNTY PERSONNEL RULES AND POLICIES

Section 2-300 Colusa County Personnel
Rules and Policies

The Board of Supervisors, by resolution, shall adopt and establish a “Colusa County Personnel Rules” and other policies as needed, which shall provide for the administration and regulation of all county personnel, regulate the method of appointment and promotions of employees, the conditions of employment, and employee-employer rights. The Personnel Rules and policies may be amended from time to time by resolution of the board.

SECTION 4 SEVERABILITY.

If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of the ordinance. The Board of Supervisors hereby declares that it would have passed this ordinance and every section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more section, subsection, sentence, clause, or phrase be declared unconstitutional or invalid.

SECTION 5.  CONFLICTING LAWS.

For the term of this ordinance the provisions of this ordinance shall govern.  To the extent that there is any conflict between the provisions of this ordinance and the provisions of any other County code, ordinance, resolution or policy, all such conflicting provisions shall be suspended.

SECTION 5.  EFFECTIVE DATE.

This ordinance shall take effect thirty (30) days from its passage.  It shall be published once with the names of the members of the Board of Supervisors voting for and against the ordinance in a newspaper of general circulation published in the Count of Colusa, State of California, within fifteen (15) days after its passage.  

Introduced at a regular meeting of the Board of Supervisors held on the 12th day of October 2021, and passed and adopted by the Board of Supervisors of the County of Colusa, State of California, at a regular meeting of the Board of Supervisors on the 26th day of October, 2021 by the following vote:

AYES: Supervisors Daurice K. Smith,
Denise J. Carter, J. Merced Corona,

and Gary J. Evans. 

NOES: None. 

ABSENT: Supervisor Kent S. Boes.
